Terms and Conditions – Spirit of Nature Safaris

Spirit of Nature Safaris (hereinafter “Spirit of Nature Safaris”, “we” or “us”) operates trips in Tanzania and across Africa. By making a booking with us, you accept the following Terms and Conditions, which form your contract with us.


1. Trip Itinerary

All clients receive a detailed itinerary outlining destinations, activities, and accommodations. While we strive to provide all agreed services, unforeseen circumstances such as road closures, bad weather, security considerations, or other local conditions may require changes. We will inform clients promptly and make alternative arrangements of equivalent quality whenever possible.

Clients must accept that conditions in Tanzania/Africa may differ from developed countries. Local fees, taxes, or park charges may change without notice, and these may be passed on to clients.


2. Payment Terms

  • Upon booking confirmation, clients receive an invoice detailing the itinerary cost.

  • A 45% deposit is required to confirm the reservation, and 100% upfront payment for airline tickets.

  • The balance is due 65 days before departure.

  • Bookings made within 65 days of departure require full prepayment.

Methods of Payment: Bank wire/transfer.


3. Cancellation Policy

Cancellation charges (excluding international flights) are as follows:

  • 65+ days before departure: deposit non-refundable

  • 50–65 days before departure: 50% of itinerary cost

  • 0–50 days before departure: 100% of itinerary cost

Changes to confirmed itineraries may incur an additional fee of $150.


4. Website Pricing

  • All prices are per person, based on double occupancy unless otherwise stated, and quoted in USD ($).

  • Costs for visas, passports, tips, insurance, additional excursions, or personal expenses are not included.

  • Prices are indicative and valid for 2 weeks. Final costs are confirmed in the invoice.


5. Travel Documents

All travel documents (vouchers, e-tickets, luggage labels) are provided two weeks before departure.


6. Insurance

Clients are responsible for comprehensive travel and medical insurance, covering themselves and any traveling companions. This should include:

  • Medical expenses and repatriation

  • Optional coverage: trip cancellation, baggage loss, emergency evacuation


7. Passports and Visas

  • Clients must ensure passports and visas are valid for the countries visited.

  • Tourist visas are available on arrival in Tanzania ($50 per person, $100 for US citizens) or in advance through embassies.

  • Passports must have at least six months’ validity after travel.

  • Spirit of Nature Safaris is not liable for visa issues or costs.


8. Booking and Contract

  • Booking confirms acceptance of these Terms and Conditions.

  • Spirit of Nature Safaris does not offer pre-set package holidays but creates tailor-made itineraries.

  • A binding contract exists once:

    • 50% deposit is received, or

    • Full payment is made if booking is within 12 weeks of departure.

  • Full payment is required 12 weeks prior to departure.


9. Medical Conditions and Disabilities

Clients must disclose any medical conditions or disabilities at the time of booking. We may decline bookings or cancel if we cannot safely accommodate needs.


10. Documentation

Clients must check all confirmation documents for accuracy and notify us within 14 days of errors. We are not liable for costs resulting from late notification of inaccuracies.


11. Amendments and Cancellations by Clients

  • Changes must be requested in writing.

  • Change fees: $75 per person ($100 for US clients).

  • Cancellation charges apply as per Section 3.


12. Amendments and Cancellations by Spirit of Nature Safaris

  • We reserve the right to make changes or cancel for reasons including force majeure, flight changes, or unforeseen circumstances.

  • Minor changes will be communicated; major changes (e.g., flight alterations >12 hours or accommodation changes) allow clients to accept, reschedule, or receive a full refund.

  • Compensation is limited to $75 per person for cancellations by us (excluding force majeure).


13. Force Majeure

We cannot accept liability for events beyond our control, including:

  • War, civil unrest, or terrorism

  • Natural disasters, epidemics, pandemics

  • Transport disruptions, technical issues, or strikes

  • Extreme weather conditions

No refunds are given for force majeure events unless recoverable from suppliers.


14. Our Responsibilities

  • We ensure services meet reasonable local standards as described.

  • We are not responsible for services not included in the contract or extra activities/excursions booked separately.

  • We accept liability for negligent acts of employees or direct suppliers resulting in death, injury, or illness, limited to 200% of holiday price (except in cases of personal injury or death).


15. Carriers

Transport by air or sea is subject to carrier terms and international conventions. We are not liable for:

  • Flight cancellations, strikes, or schedule changes

  • Lost luggage, missed accommodation, or operational decisions of carriers

  • Death, injury, or illness during carriage


16. Law and Jurisdiction

This contract is governed by Tanzanian law, and disputes are subject to the courts of Dar es Salaam.


17. Referral Waiver

Clients referred by third parties (e.g., travel agents) waive claims against the introducer. Any issues must be resolved under these Terms and Conditions.


18. Problems During Holiday

Clients must report problems immediately to the relevant organizer (guide, hotel manager, etc.). Unresolved issues must be submitted in writing within 28 days of return. Failure to follow this procedure limits our liability.
